SMS Consent Evidence

This page documents, for carrier and messaging-provider review, how BAILSAFEPRO, LLC collects and records consent for transactional text messages. All examples below are synthetic. No production tenant, agency, defendant, or client data appears on this page.

Program name: BailSafePro Alerts. Operator: BAILSAFEPRO, LLC, a B2B software company. Licensed bail agencies use the platform to message their own clients. Message types:

Two separate permissions

BailSafePro keeps two distinct, independently recorded SMS permissions. Granting one never grants the other, and both are tied to one exact mobile number.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help. Consent applies only to the specific number given; changing the number requires a new opt-in, and a STOP on a number blocks both permissions for that number.

1. Defendant exact-number consent (secure portal)

After signing a bail bond, the defendant signs in to their secure BailSafePro portal and checks an unchecked consent box, separate from acceptance of the Terms. Sample disclosure text: “I agree to receive text messages from my bail agency through BailSafePro about my check-ins, court dates, secure portal messages and requested application links at the mobile number I provided. Consent is not a condition of any service. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out, HELP for help.” Stored evidence: agency, exact E.164 number, source, disclosure version, actor, and timestamp.

2. Send Online App attestation

When a person contacts an agency and asks for a bail application, agency staff type that person’s mobile number and must affirm an on-screen attestation that the recipient requested the link before the message can be sent. The attestation, actor, agency and timestamp are recorded with the number.

3. Text2Apply keyword opt-in

The person texts the agency’s published keyword first. The inbound message is itself recipient-initiated consent and is stored as the consent record for that number.

4. STOP / START / HELP

STOP (and CANCEL, QUIT, UNSUBSCRIBE, END, STOPALL, OPTOUT, REVOKE) immediately revokes consent for that number and writes an opt-out event. START or UNSTOP resubscribes. HELP or INFO returns program, operator and support contact information. Provider-side advanced opt-out handling is authoritative; BailSafePro does not send a duplicate reply.

Recipient-bound consent — each person, each number

Every messaging destination stands on its own permission. The defendant, an indemnitor/co-signer, and a permitted extra court contact each require their own affirmative, number-bound consent before any message is sent to them.
